End User License Agreement (EULA) — MilkTune
Version 2.0 — Effective Date: April 23, 2026

1. Agreement to Terms

By downloading, installing, accessing, or using MilkTune (“Application”), you agree to be bound by this End User License Agreement (“Agreement”). If you do not agree, do not use the Application.

2. Definitions

“You” / “User”: the individual or entity using the Application.
“MilkTune”: the licensor and publisher of the Application (“we”, “us”, “our”).
“Data”: any information you enter, import, generate, export, or store using the Application, including production, sales, costs, tasks, feeding inputs, and discard reasons.
“Reports”: any on-screen summaries, charts, exports, or PDF/printed files generated by the Application from your Data.
“Installation identifier”: a technical identifier associated with a specific installation of the Application on a device, used only for limited operational purposes such as licensing continuity, subscription status, security, and access validation.
“Third-Party Services”: external platforms or services involved in distribution, billing, subscription management, licensing, telemetry-related infrastructure, support channels, integrations, or related platform dependencies, including app stores and related providers.

3. Incorporation of Privacy Policy and Other Notices

Your use of the Application is also subject to MilkTune’s Privacy Policy and any in-app notices or disclosures, including those presented in the user manual. The Privacy Policy is incorporated by reference into this Agreement. If this Agreement and the Privacy Policy address the same topic and conflict, the Privacy Policy governs how information is collected, processed, and handled, and this Agreement governs licensing and usage terms.

4. Eligibility and Intended Audience

The Application is intended for adult users or legally authorized business operators. You represent that you are at least the legal age of majority in your place of residence, or that you have valid authorization to use the Application on behalf of an entity. The Application is not intended for children.

5. Nature of the Application (What It Is)

MilkTune is a simple, offline-first tool designed to help small milk producers record, organize, and review important day-to-day farm information. This includes milk production, sales, costs, milk discard and discard causes, basic tasks, and certain feeding-related inputs that may support discussions with qualified professionals.

The Application is intended to give small producers a BASIC AND PRACTICAL UNDERSTANDING of their farm operation and finances, especially where there may otherwise be little or no organized control. In this sense, MilkTune functions more like a SIMPLE FARM RECORDKEEPING TOOL for records and summaries than like a complete farm management or accounting system.

Its purpose is to support ORGANIZATION, VISIBILITY, AND SIMPLE RECORDED RESULTS based on information entered by the User. It IS NOT intended to replace professional judgment, deeper financial analysis, or guidance from qualified professionals.

6. What the Application Is Not (No Advice / No Recommendations)

MilkTune:

• IS NOT a complete dairy farm management system;
• IS NOT a replacement for professional advice, such as veterinary, accounting, or financial advice;
• IS NOT an accounting, management-accounting, or full financial-control system;
• IS NOT a source of market prices or external economic data;
• IS NOT a decision-making, recommendation, or prescription system;
• DOES NOT currently monitor milk quality data and, at this stage, mainly helps record and summarize milk production, milk discard, discard causes, sales, costs, basic tasks, and selected feeding inputs;
• DOES NOT manage inventories, depreciation, interest, provisions, or accounts payable and receivable, except to the extent such items are explicitly recorded by the User in the Application;
• DOES NOT automatically allocate recurring costs across different periods when those costs were not recorded in the selected time window;
• DOES NOT provide veterinary, nutritional, technical, financial, accounting, legal, or tax advice;
• IS NOT a substitute for qualified professionals.

All outputs, charts, summaries, and Reports are INFORMATIONAL ONLY. They are based only on records entered into the Application and may not reflect the full financial reality of the farm or business.

The usefulness of these outputs depends on the quality, completeness, timing, and correct interpretation of the information entered by the User.

You should NOT RELY ON the Application as the only basis for important decisions involving finances, accounting, animal health, nutrition, legal matters, taxes, operations, or safety.

Whenever deeper analysis, validation, or important business decisions are involved, you should seek help from a QUALIFIED PROFESSIONAL, such as an accountant, bookkeeper, financial advisor, veterinarian, zootechnician, or nutrition professional, depending on the situation.

7. Local-First Operation, On-Device Storage, and Limited Connectivity Needs

MilkTune is designed as a local-first Application. Your detailed farm records are stored on your device by default, and MilkTune does not upload your complete farm database as part of normal operation.

Although the Application is designed for offline-friendly daily use, an internet connection may be required for limited operational purposes such as initial license activation, purchase validation, subscription status verification, future license renewals, entitlement-related checks, or certain platform-dependent functions. If connectivity is unavailable at those moments, certain gated features may be temporarily unavailable until the relevant licensing, subscription, or platform-dependent flow can be completed.

8. Data Collection Limits, Privacy Orientation, and App Usage Telemetry

The Application is designed to avoid routine collection of your detailed farm records, production records, commercial records, or other business records on MilkTune’s servers.

MilkTune does not currently collect, create, or transmit market data snapshots derived from your farm records in the current version of the Application.

MilkTune may process limited aggregated app usage signals for product quality, stability, compatibility, and usability improvement. This telemetry is limited to app-usage information such as which screens are more used, which features are used more often, error counts, and crash or performance-related diagnostics. It is not intended to include your farm database, detailed farm entries, partner names, or free-text operational notes.

MilkTune may also provide optional in-app features that allow you, on your own initiative, to submit bug reports, error reports, or product feedback. These submissions are separate from automatic telemetry. They may include free-text content that you choose to provide voluntarily. Because these submissions are not designed to identify you individually, MilkTune may not be able to provide a direct response to a specific report, although the information may still be used to improve future versions of the Application.

9. User Responsibilities (Accuracy, Interpretation, and Seeking Professional Help)

To obtain the best results and avoid misleading outputs, you agree that you will:

• enter Data regularly, accurately, and completely;
• keep production, income, and expense records consistent;
• understand that Reports are only as good as the Data you enter and your ability to interpret them correctly;
• seek help from a qualified accountant, bookkeeper, financial professional, veterinarian, zootechnician, or nutrition professional when needed;
• maintain reasonable security of your device, such as PIN/password protection, OS updates when possible, and general device care.

You acknowledge that the Application does not verify correctness of your inputs and does not guarantee that Reports reflect reality if your Data is incomplete, inconsistent, or incorrectly recorded.

10. Reports Are Auto-Generated From Your Inputs

All Reports are generated automatically by the Application based solely on your Data. The quality, completeness, and usefulness of Reports depend directly on the quality, consistency, and completeness of your inputs. Missing days, wrong categories, incomplete milk volumes, incorrect costs, or inconsistent entries can materially distort results.

11. Diet / Feeding Module Disclaimer

If feeding or diet features are enabled, you understand and agree that the relevant module is a simple calculator, similar to paper-and-pencil or a spreadsheet. It summarizes nutrition-related information based only on the feed Data you enter, does not judge diet quality, and does not provide recommendations.

Any evaluation of diet adequacy, safety, health implications, and feeding strategy must be performed by a qualified veterinarian, zootechnician, or animal nutrition professional. Any diet change remains your responsibility.

You also acknowledge that feed composition and bromatological fields should preferably be filled with the assistance of a qualified professional and/or based on reliable lab analysis or validated references. Incorrect inputs can produce misleading outputs.

12. Backups, Data Loss, and Deletion / Reinstall Risk

Because MilkTune stores detailed farm records locally on your device, regular backups are important.

Before deleting or reinstalling the Application, you should export a backup of your data.

If you delete the Application, reset your device, lose your device, replace your device, or erase local data without a backup, your Data may be permanently lost and may not be recoverable by MilkTune.

If your backup is encrypted and you lose the backup password, the backup may not be recoverable.

13. Settings Constraints (Currency, Location, and History Consistency)

To preserve history consistency and comparability:

• the database currency may be fixed once you already have Data and may not be changeable without erasing the database and starting over;
• location-related settings may be limited in certain cases, and you should check carefully before confirming changes.

14. Notifications and Device Restrictions

If you enable task reminders, you understand that delivery depends on your device settings, notification permission status, battery saver restrictions, background execution rules, and related platform controls. Reminders may be delayed or not delivered. You are responsible for configuring your device appropriately if you rely on notifications.

15. Updates and Version Responsibility

MilkTune may release updates, upgrades, patches, fixes, or supplemental versions that improve stability, calculations, security, compatibility, exports, or Reports. Unless such release is accompanied by separate terms, it will be deemed part of the Application and governed by this Agreement.

You agree that you should install updates in a timely manner to remain on the best available version. Running an outdated version may result in incorrect behavior, missing fixes, reduced compatibility, or issues with licensing and exports.

16. Bug Reporting and Feedback

If you identify a bug or incorrect behavior, you may report it using the in-app bug report or feedback features, when available. These reports are separate from automatic telemetry and are provided voluntarily by you. MilkTune does not guarantee a specific response time, fix timeline, or individualized support. Because such reports are not designed to identify you individually, MilkTune may not be able to respond directly to a particular submission.

17. Exports, Third-Party Reliance, and External Decisions

Exports, including shareable files, summaries, and PDF Reports, are derived from your Data and are provided for convenience, backup, organization, and sharing. MilkTune is not responsible for decisions made by third parties, including cooperatives, dairies, veterinarians, technicians, accountants, banks, or government bodies, based on your exports or interpretations of your Data.

You are responsible for complying with applicable laws and rules when sharing Reports or records.

18. Learning Curve and Limited Support Policy

You acknowledge that the Application may require an initial learning curve to use effectively. To better understand the Application’s features, limits, expected workflows, and interpretation boundaries, you should carefully review the user manual and in-app guidance before relying on the Application for routine recordkeeping, exports, or interpretation of Reports.

MilkTune is designed for broad accessibility and largely autonomous use, supported by a user manual and in-app guidance. MilkTune does not provide guaranteed individualized support, real-time assistance, custom consulting, or training on demand for every request. Support, when offered, is generally limited to documentation, general instructions, and basic troubleshooting guidance, and may be provided at MilkTune’s discretion and availability.

19. App Store / Billing Terms (Subscriptions, Renewals, Refunds)

If you purchase subscriptions or paid features through an app store or similar platform, that platform may act as merchant of record and may handle billing, renewals, cancellations, and certain refund policies. You are responsible for managing your subscription, including cancellation, through the platform where you purchased it.

Unless required by applicable law or by the relevant platform’s policy, payments are non-refundable. Taxes, fees, or currency conversion charges may be applied by the store or your payment provider.

20. Commercial Terms and Service Changes

MilkTune may change pricing models, introduce paid features, or modify the availability of free or paid features from time to time, subject to applicable law and platform rules. Where reasonably practicable, material commercial changes will be communicated through the Application, the relevant app store listing, or another appropriate channel. Continued use of the Application after such changes take effect constitutes your agreement to the updated commercial terms, to the extent permitted by law.

MilkTune may also modify, suspend, or discontinue the Application, or any feature, plan, or availability of the Application, whether temporarily or permanently, for technical, business, legal, security, or maintenance reasons, subject to applicable law. Where reasonably practicable, MilkTune will seek to provide prior notice of material changes, suspension, or discontinuation.

Because your detailed farm records are stored locally on your device and the Application is designed for local-first use, you are responsible for keeping your own backups and exporting any Reports or records you wish to retain. Where available in the relevant version of the Application, MilkTune may also provide export tools, including spreadsheet-compatible exports, to support retention of your business records and, if you choose, your own migration to another tool or system.

21. Additional Terms for Installations Obtained Through the Apple App Store

If you obtained the Application through the Apple App Store, the following additional terms apply to that installation:

Apple and its subsidiaries are not parties to this Agreement, except as third-party beneficiaries of this Section. As between MilkTune and Apple, MilkTune, not Apple, is the licensor of the Application and is solely responsible for the Application itself, its content, its functionality, and any maintenance, support, or service obligations relating to it.

You acknowledge and agree that Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Application.

You acknowledge and agree that, as between MilkTune and Apple, MilkTune, not Apple, is responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including product liability claims, claims that the Application fails to conform to applicable legal or regulatory requirements, consumer protection claims, privacy claims, and similar claims, in each case to the extent required by applicable law.

You further acknowledge and agree that, in the event of any third-party claim that the Application or your possession and use of the Application infringes that third party’s intellectual property rights, MilkTune, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of such claim, to the extent required by applicable law.

If subscriptions, paid features, or other purchases are made through the Apple App Store, Apple or its affiliates may act as merchant of record and may handle billing, renewals, cancellations, and refunds in accordance with Apple’s applicable terms, platform rules, and policies. You are responsible for managing your subscription or purchase settings through your Apple account and the relevant Apple-provided interfaces where applicable.

You acknowledge that availability of certain platform-related features, purchase flows, subscription status checks, entitlement-related checks, or other App Store-dependent functionality may depend on Apple services, platform rules, device state, account status, operating system behavior, or regional availability, and such elements may change, be unavailable, or be discontinued from time to time.

To the maximum extent permitted by applicable law, Apple and Apple’s subsidiaries shall have the right to enforce this Section against you as third-party beneficiaries of this Agreement.

Nothing in this Section is intended to limit any non-waivable rights you may have under applicable law.

22. Third-Party Services and Platform Dependencies

The Application may interact with, depend on, or be distributed through Third-Party Services, including app stores, billing providers, subscription providers, backend infrastructure providers, operating systems, related integrations, and platform services. You use such Third-Party Services at your own risk.

These Third-Party Services may have their own terms, privacy policies, technical restrictions, service interruptions, account requirements, permission models, hardware or operating-system dependencies, connectivity requirements, or regional availability limits. MilkTune does not control and is not responsible for third-party outages, policy changes, billing platform rules, content made available by third parties, or platform restrictions beyond MilkTune’s reasonable control.

MilkTune does not audit, examine, or guarantee Third-Party Services, their availability, their security, their content, or the accuracy, completeness, or usefulness of information, content, or functionality provided by them.

Third-Party Services and platform-dependent features may change, be restricted, be suspended, be removed, become unavailable, or be discontinued at any time, temporarily or permanently, with or without notice, subject to applicable law.

23. Intellectual Property and Brand Restrictions

The Application, including its software, design, logos, trademarks, text, layout, and documentation, is owned by MilkTune or its licensors and is protected by applicable intellectual property laws. Except for the limited license expressly granted in this Agreement, no right, title, or interest in or to the Application or any related intellectual property is transferred to you.

You may not use MilkTune’s name, logo, or trademarks in a way that suggests endorsement or affiliation without prior written permission.

To the extent the Application includes any open-source or third-party software components distributed under separate license terms, those components remain subject to their respective license terms.

24. License Grant and Restrictions

MilkTune grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application solely for your internal farm management purposes, and only on devices that you own or lawfully control.

You agree not to:

• copy, reproduce, modify, translate, or create derivative works of the Application except as permitted by applicable law;
• reverse engineer, decompile, disassemble, or attempt to extract the source code of the Application except as permitted by applicable law;
• resell, sublicense, rent, lease, distribute, redistribute, share, or otherwise make the Application, or copies of it, available to third parties, except as expressly permitted by the relevant app store or applicable law;
• commercially exploit the Application or any portion of it;
• share access or use the Application in ways that bypass licensing limits, subscription limits, or platform rules;
• make the Application available over a network or other arrangement where it could be used by multiple users or multiple devices at the same time, except where such use is expressly permitted by applicable law or by the relevant platform rules;
• use the Application or any integration, service connection, or related feature in any unlawful, abusive, fraudulent, defamatory, threatening, harassing, rights-infringing, or otherwise improper manner.

Any use of the Application outside the scope of this license or in breach of this Section may result in suspension or termination of your rights under this Agreement, in addition to any other remedies available under applicable law.

25. Disclaimer of Warranties

To the maximum extent permitted by applicable law, and subject to any mandatory consumer rights that cannot be excluded or limited, the Application is provided on an “AS IS” and “AS AVAILABLE” basis.

MilkTune does not warrant that the Application will be uninterrupted, error-free, always available, or suitable for every specific purpose or business context. MilkTune also does not warrant the accuracy, completeness, or usefulness of outputs where those outputs depend on your Data, device conditions, platform behavior, Third-Party Services, or your interpretation of the information presented.

No oral or written information, guidance, statement, or advice provided by MilkTune or its representatives will create any warranty unless expressly stated in a written agreement signed by MilkTune.

Nothing in this Agreement excludes or limits any warranty or right that cannot be excluded or limited under applicable law.

26. Limitation of Liability

To the maximum extent permitted by applicable law, and subject to any mandatory consumer rights or other rights that cannot be excluded or limited, MilkTune will not be liable for any indirect, incidental, special, consequential, exemplary, or similar damages, including loss of profits, loss of revenue, loss of data, business interruption, loss of business opportunity, loss arising from service outages, or losses arising from your use of, or inability to use, the Application.

MilkTune will also not be liable for losses arising from inaccurate, incomplete, inconsistent, or incorrectly entered Data; from device conditions; hardware or operating-system limitations; account status; permissions; connectivity failures; notification restrictions; Third-Party Services; platform behavior; service suspensions, restrictions, removals, or discontinuations by third parties; loss of local data without a backup; or from your interpretation or third-party reliance on Reports or exports generated from your Data.

Nothing in this Agreement excludes or limits liability to the extent such exclusion or limitation is not permitted under applicable law. Where applicable law grants you mandatory rights or remedies, those rights and remedies remain unaffected.

27. Force Majeure

MilkTune will not be responsible for delays, outages, or failures caused by events beyond its reasonable control, including failures of networks, power, app stores, operating systems, device manufacturers, third-party services, natural disasters, or legal/regulatory actions.

28. Termination

This Agreement is effective until terminated. MilkTune may terminate or suspend your license if you materially breach this Agreement, including by using the Application outside the scope of the license granted in this Agreement or in violation of the restrictions set out herein.

Upon termination, you must stop using the Application and destroy all copies in your control, except backups you lawfully created.

29. Changes to This Agreement

MilkTune may update this Agreement from time to time. The Effective Date at the top indicates when the current version takes effect. If you continue to use the Application after an updated Agreement becomes effective, you agree to the updated terms, to the extent permitted by law.

30. Governing Law

This Agreement is governed by the laws applicable in the jurisdiction where MilkTune is established, excluding conflict-of-laws principles. If you reside in a country, state, or region that grants consumers mandatory rights, including mandatory consumer protection rules, those mandatory provisions will apply and are not limited by this Agreement.

31. Severability; Entire Agreement; No Waiver

If any provision of this Agreement is found unenforceable, the remaining provisions will remain in effect. This Agreement, together with the Privacy Policy and any in-app notices incorporated by reference, constitutes the entire agreement between you and MilkTune regarding the Application and supersedes prior understandings on the same subject. Failure to enforce any provision is not a waiver of the right to enforce it later.
